This Privacy Policy describes our practices with respect to personal data collected via our website at kolegial.pl (hereinafter: Website). It also contains information about the rights that Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: GDPR) and other data protection laws grants You as the data subject.

The owner of the Website and consequently the controller of Your personal data is Kolegial limited liability company with it’s registered office in Poznań (61-546) at Czajcza 2a/12 entered into the register of entrepreneurs of the National Court Register by District Court of PoznańNowe Miasto i Wilda in Poznań, VIII Commercial Division of the National Court Register under KRS No: 0000785358, tax identification number NIP: 7831801781, statistical number REGON: 83364171, with a share capital amounted to PLN 5.100,00, (hereinafter: Kolegial or Us).

Our Website has some functions that may be associated with the processing of Your personal data. The most important is the opportunity to contact us. What's more, on Our Website We use cookies and other technologies that allow Us to collect statistics and implement improvements.

As the data subject - under the GDPR and other data protection legislation – You have some privileges. Please be aware that You have the right to:

We collect data about users of Our Website in logs, system websites, through so-called cookies and other technologies (e.g. pixels, SDK codes). Thanks to them, we know which subpages of our Website You have visited or how many times You have visited Our Website.. We use the abovementioned technologies to increase the effectiveness and security of the Website, personalize the Website to suit Your needs better and enable faster finding information.

3.1. What are the purposes and legal bases of processing Your data when You want to contact Us?  

If you decide to contact Us, Your data will be processed, because it is necessary for the purposes of the legitimate interests pursued by You and Us (on the grounds of article 6 paragraph 1 letter f of the GDPR). Thanks to the data You provide, we will be able to communicate effectively. In addition, Your data may be processed in order to present our services on the basis of article 6 paragraph 1 letter b of the GDPR.

3.2 How long your data is stored?  

Your data will be processed throughout our communication and then, if we cooperate no more or there is no purpose other than that for which they have been collected – we will retain them only for the period necessary to establishment, exercise or defence of legal claims. 

3.3 Who We share Your data with? 

Kolegial uses the services of other entities processing personal data on its behalf, inter alia administrative, accounting, IT and server services, services of maintaining and operating IT systems and databases.

In connection with the use of certain IT systems, your personal data may be transferred outside the European Economic Area, in particular to the United States. The entities with which Kolegial cooperates meet the security requirements imposed by the relevant provisions on the protection of personal data. The transfer of data to the United States takes place as part of the Privacy Shield program, whose participants are entities processing data on behalf of Kolegial. Transfer of data to other countries is carried out under standard contractual clauses issued by the European Commission. Kolegial provide access to these clauses at its headquarters.

3.4 Do You need to provide data?  

Providing data by You is voluntary. We will start processing activities only at Your request, when You decide to contact us. 

4. FINAL PROVISIONS  

4.1 Changes in Privacy Policy  

We are constantly developing Our Website, so We may update this Privacy Policy from time to time. Changes come into force with the moment they are published. About important changes We will also inform You by an additional announcement displayed on the Website.

The purposes and the legal basis for the processing 

Your personal data will be processed by Kolegial in order to:

  1. answer questions about services We provide, to conclude and execute legal services agreement - pursuant to article 6 paragraph 1 letter b) of the GDPR and article 6 paragraph 1 letter c of the GDPR;
  2. fulfill the obligations imposed by tax law (including issuing and settlement of invoices) - pursuant to article 6 paragraph 1 letter c of the GDPR;
  3. establish, exercise or execute legal claims or defend against claims which is execution of the legitimate interest of the data controller, as well as to prevent abuses and frauds - pursuant to article 6 paragraph 1 letter f of the GDPR;

If it is related to the nature of the case in which Kolegial provides legal services, processing of data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data, data concerning health or data concerning a natural person's sex life or sexual orientation (pursuant to article 9 paragraph 2 letter a and f of the GDPR) and/or data relating to criminal convictions and offences or related security measures (pursuant to article 10 of the GDPR) may occur.

 

The period of data storage

Your personal data will be processed for the period necessary to achieve the purposes for which they were collected by Kolegial. In particular for the period of:

  1. 10 years from the date of termination of the proceedings in connection with which personal data were collected, in particular civil, criminal and administrative proceedings;
  2. 10 years from the date of termination of cooperation between the parties, if personal data were not collected in connection with the proceedings.

The periods of data processing mentioned above may be extended if relevant law provisions order to do so.

 

Your rights as data subject  

Due to processing of Your personal data by Kolegial You have the right to:

  1. request access to Your personal data and receive a copy of it
  2. rectification (correction) Your personal data 
  3. erasure Your personal data 
  4. restriction of processing personal data
  5. data portability to another controller

Your right to access Your data and receive a copy of it, as well as the right to restriction of processing personal data is exercised by Kolegial only to the extent that does not violate the attorney-client privilege.

Data recipients

Kolegial uses the services of other entities processing personal data on its behalf, inter alia administrative, accounting, IT and server services, services of maintaining and operating IT systems and databases.

Your personal data may also be processed by law firms with which We cooperate on the basis of a written contract.

In addition, access to your data can be obtained by Kolegial employees and contractors, employees  of state bodies and offices authorized to exercise control or supervision over Kolegial’s activities.

 

Transfer of personal data outside the European Economic Area

Voluntary submission of data, no automated decision making

Providing Your personal data is voluntary, but necessary to answer the questions asked, perform the legal services agreement and fulfill obligations imposed by public law.

Kolegial will not make automated decisions basing on your personal data, including decisions resulting from profiling.
